Sovereignty and its various forms have always been a matter of
consideration by men of political thought. Different approaches of
followers of religions and those of Islam have also been considered in
the process of sovereignty. In the Islamic Jurisprudence some such
subjects as custom, reason, interest, and implicit interests have affected
the realm of interference of religion with sovereignty in one way or
another. Such titles are recognized by human approaches being
considered as common legal sources and essentials in governing
societies. When two affairs of primary precepts interfere, what is more
important is given priority. In interference of social necessities with
primary precepts, Islam has given priority to the former and having
taken common essentials into consideration has treated secondary
precepts as the foundation of sovereignty. Thus, in the Islamic juristic
approach human wills are given remarkable status in sovereignty.
